Welcome to Aura! We're thrilled to have you join our community. At Aura, we believe that other social apps are too fake. They like to pretend that life is always sunshine and rainbows. At Aura, we encourage you to share the W's and the L's because making fun of yourself is the best way to make yourself feel better. These Terms & Conditions (the "Terms") are here to ensure that everyone knows what's expected, both from us and from you. So please take a moment to read through them. 2. Acceptance of Terms

By accessing or using Aura, you agree to these Terms & Conditions. If you don't agree, Aura may not be the platform for you.

3. Eligibility

To join the Aura community, you need to be a real person - no bots or AI here! You must be at least 13 years old. However, if the minimum age for using social media in your country is higher than 13, you must comply with the local age requirement. If you're under the age of consent in your country, you'll need a parent or guardian to give their consent for you to use Aura. If you're creating an account for someone else, like a company or organization, you need to have the authority to do so. When we say "you," we mean both you, the end user, and, if applicable, the entity you represent.

4. Account Registration and Security

To use Aura, you'll need to create an account with your name, phone number, and, if needed, your email address. Keep your account information secure, because you're responsible for everything that happens under your account.

5. User Conduct

You agree to use Aura in a lawful manner and adhere to our content guidelines. Prohibited behaviors include, but are not limited to:

6. Content Ownership and Rights

Content means profile photos, photos, videos, emojis, captions, comments, or messages shared through our Services.

You own the content you share on Aura, and we think that's pretty great. Here's how it works:

Friends Only Content: Content you share only with your friends on Aura. If you decide to let us use your Friends Only Content for things like marketing or promotions, we'll need you to give us a license to do that. This is entirely voluntary.

Public Shared Content: Content you share with everyone on Aura. By sharing content publicly, you give us a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute that content in any and all media or distribution methods. This license helps us to make Aura better and lets us show off the awesome stuff our users create.

7. Privacy and Data Protection

10. Analytics

In order to make the best product we can, Aura collects analytics data to inform our product decisions. We collect a variety of analytics including usage data, performance data, location data for geofencing analytics, and other miscellaneous metrics like which permissions are enabled for Aura. Permissions such as contacts, photo gallery, camera, and notifications are also tracked and stored to ensure optimal functionality.

11. Third-Party Services

Aura integrates with various third-party platforms and reserves the right to integrate with additional services in the future. These integrations help improve the platform's functionality. User data and content information may be shared with these third-party services to enhance user experience.

12. Termination of Account

Accounts may be terminated for repeated offenses against our content guidelines. Users will be notified of prohibited content and may appeal terminations via email and a provided form.

While we employ advanced data privacy measures and content moderation tools, Aura cannot guarantee the absence of potential risks such as data breaches or exposure to inappropriate content. By using Aura, you agree to the following limitations of liability:

15. License to Use Services

During the time you are using our Services, Aura grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided as part of our Services. This license is solely for the purpose of enabling you to use and enjoy Aura in a manner consistent with these Terms. This license ends when you stop using our Services.

16. Dispute Resolution

We hope to resolve any issues you have with Aura quickly and efficiently. However, if a dispute does arise, here's how we'll handle it:

Arbitration

Any disputes arising out of or relating to these Terms, the use of Aura, or the relationship between you and Aura will be resolved through binding arbitration. This means that an arbitrator, rather than a judge or jury, will decide the dispute. Arbitration will be conducted under the rules of the American Arbitration Association (AAA) and will take place in a mutually agreed-upon location.

Jurisdiction and Governing Law

These Terms and any disputes or claims arising out of or in connection with them will be governed by and construed in accordance with the laws of the state or country in which Aura operates, without regard to its conflict of law principles. You agree to the exclusive jurisdiction of the courts located in that state or country for the resolution of any disputes that are not subject to arbitration.

Class Action Waiver

To the extent permitted by applicable law, you agree to resolve any disputes with Aura on an individual basis and not as part of a class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Exceptions

Notwithstanding the above, you and Aura both retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

By using Aura, you agree to these dispute resolution terms, and you acknowledge that you understand and accept them.
